I-FRAME PRIVACY NOTICE AND TERMS OF USE

1.1             This application form (the Form) is owned by Loan Machine Limited  trading as Lead Affinity (company number 05517368), a company incorporated in England and Wales with registered office at 170 High Street, Gorleston, Great Yarmouth, Norfolk, NR31 6RG (Lead Affinityweusour).

1.2             Lead Affinity is committed to protecting and respecting your privacy in the delivery of our Services (which are outlined in section 2 below). We have developed this statement so you understand how we deal with your information and because we want you to feel confident about the privacy and security of your personal information in connection with our Services.

1.3             The statement also outlines some of your rights, how to contact us if you have further questions and the terms of using the Form. Please read the details set out below before using this Form (the Privacy Notice and Terms). By completing the Form and submitting your data, you agree that we may use your data as we have explained and to be bound by the following terms and conditions. If you do not agree, please refrain from using the Form.

1.4             The Form is hosted on the website of a company affiliated with Lead Affinity (the Affiliate). Your use of the main website and of the other webpages operated by the Affiliate will be subject to the Affiliate’s Website Terms of Use and its Privacy Policy which can be accessed via the main website. The Affiliate is a third party organisation that acts as a lead generator for Lead Affinity, hosting and presenting the Form on its webpages and it is not a subsidiary or a member of Lead Affinity’s Company Group. The data you input within the Form is forwarded directly to Lead Affinity so that we can deliver our Services.

1.5             To consider how the Affiliate and Lending Partners use your data, you should consider the Affiliate's own privacy policy and website terms of use.

2           INFORMATION ABOUT US

2.1             Lead Affinity is an introducer, carrying out the business of credit brokerage in the United Kingdom. We do not lend money in the capacity of a lender and we do not make the decision to lend to you.

2.2             As a credit broker, we are regulated by the Financial Conduct Authority (FCA) under the Consumer Credit Act 1974 and the Financial Services and Markets Act 2000. We hold FCA Interim Permission with number: 576459.

2.3             We are also registered with the Information Commissioner's Office (ICO) in compliance with the Data Protection Act (the Act). Our registration number is Z9250764. You can review general information on how we process your information on the ICO's public register but this statement provides specific details. 

2.4             For the purpose of the Act, the data controller of your information is Lead Affinity.

2.5             The Affiliate maintains its own registrations with the FCA and details can be obtained via the Affiliate’s Website Terms of Use or by contacting the Affiliate directly.

3           SERVICES

3.1             As an introducer and credit broker we will help you search for a loan and provide a matching service as follows (the Services). To help you with your application and search for a loan, we pass your data to a group of lenders and credit brokers (as listed in 3.2) on our lending panel (Lending Partners). The lenders on our panel may be willing to enter into a consumer credit agreement with you, subject to their assessment of your creditworthiness and the affordability of the loan among other compliance checks. On submitting your application, we also share your information with other trusted regulated credit brokers who will simultaneously endeavour to match your application with their lending partners. If we find a match, your application is redirected to the lender's website.

3.2             We have commercial links with our trusted Lending Partners and will generally receive a payment from them (not you) in the form of a commission if we are successful in matching you or if they actually fund a loan. Our panel currently consists of a large number of lenders and brokers and our matching services only relate to that group, therefore, please note that the Services do not constitute an entire market search for loan products. While our providers have been chosen to provide a variety of products, there are other products on the market that are not available from our panel and, one or more of them may be more appropriate or suitable for you, so you may wish to shop around.

Our lenders and partners with whom we share your information may use it for their legitimate business interests to match applications, carry out fraud checks, carry out research such as analysis of market trends and customer demographics and to customise and develop the product/service which they offer to you or other individuals in the future. Most lenders might use this for up to 12 months.

 

3.3             We encourage you to consider the Lending Partners' websites, FAQs, pre-contractual information and terms of the loan documentation carefully to determine whether the loan offered is suitable for your financial circumstances and whether you can afford to make the repayments under the proposed loan throughout its term.

3.4             We do not charge you a fee for the Services or offer advice which assesses the merits of entering into a particular loan. If we match you with a lender it is not a specific recommendation and we have not negotiated the terms of any loan agreements on your behalf.

3.5             As Lead Affinity is not a lender, we cannot guarantee that completing and submitting your information via the Form will result in you receiving a loan. Individual lenders may, at their discretion, require you to complete their own application process and undertake further checks.

4           INFORMATION WE MAY COLLECT FROM YOU

4.1             By submitting your personal information within the Form you acknowledge that we will acquire and transfer your data to our Lending Partners for the consideration of the provision of a loan.

4.2             We may collect and process the following data about you:

4.2.1         information that you may provide by filling in the Form. We may also ask you for information if you report a problem with the Form;

4.2.2         correspondence, or a record of it if you should contact us for any reason, together with your contact details and our responses, which could include sensitive personal information such as your health and fitness or criminal allegations/convictions;

4.2.3         financial information relating to your historic loan accounts and any loan account you enter as a result of this application;

4.2.4         technical information, including Internet protocol addresses used to connect your computer to the Internet, your login information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform; and

4.2.5         surveys that we use for research purposes, which we have asked you to complete, although you do not have to respond to them.

 

5           USE OF YOUR INFORMATION

5.1             As well as sharing your information with our Lending Partners to deliver the Services, we may also use your information in the following ways:

5.1.2         to provide you with the best possible service;

5.1.3         to notify you about changes to the Services.

5.2             In addition to the above, we may disclose the following information to third parties:

5.2.2         if Lead Affinity or substantially all of its assets, are acquired by a third party, in which case data held by us about our customers will be one of the transferred assets;

5.2.3         the particulars of your loan, such as the amount funded, with the Affiliate for their accounting and administration purposes (such information sharing will not typically include sharing your personally identifiable information, although this may be necessary to resolve complaints and disputes from time to time); and

5.2.4         if we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory request, or in order to enforce or apply our Privacy Notice and Terms and any other agreements; or to protect the rights, property, or safety of Lead Affinity or other customers.

7           CREDIT REFERENCE AND FRAUD PREVENTION AGENCIES

7.1             When you submit the Form and apply for a loan using our Services, you confirm that all the information you have given is true and complete. When you submit the form you authorise our Lending Partners to check the following records about you and others:

7.1.1         our own;

7.1.2         those at credit reference agencies (CRAs); when CRAs receive a search from lenders they may place a search footprint on your credit file that may be seen by others that check CRA records; and 

7.1.3         those at fraud prevention agencies (FPAs).

7.2             Some Lenders may make periodic checks at CRAs and FPAs to manage your accounts with them.

7.3              Please be aware that CRAs link your spouse or financial associate’s records together and these links will remain on your and their files until such time as you or your partner successfully files for a disassociation with the CRAs to break that link. 

7.4             If false or inaccurate information is provided and fraud is identified, details will be passed to FPAs. 

7.5             Financial services providers and a wide variety of other organisations, such as employers and utilities providers may also access and use this type of information for verification purposes and to prevent fraud and money laundering. 

8           WHERE WE STORE YOUR PERSONAL DATA

8.1             The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (EEA) providing they have adequate safeguards in place to protect your data. It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. By submitting your data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this statement.

8.2             We will retain your information securely stored for as long as the law or our regulators require or, otherwise for our legitimate business purposes. Your data will be will be kept for no longer than what is deemed absolutely necessary.

8.3             Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data through technical and organisational measures, we cannot guarantee the security of your data transmitted to us via the Affiliate's website or onwards to Lending Partners or any other third parties. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

8.4          Our trusted Lending Partners may receive your application and therefore may store the data you have provided that forms your application. The lending partners that may receive and store the data you submit to us are:

9           YOUR RIGHTS TO ACCESS AND CORRECT YOUR INFORMATION

9.1             The Act gives you the right to access information held about you. If you would like a copy of some or all of your information that we hold, as well as other related processing explanations, please email or write to us (using the contact details provided below). We may ask you to produce evidence of your identity to ensure it is appropriate to share the information. Such requests are free of charge unless manifestly excessive and we will provide a response to you within 30 days of receiving your request.

9.2             We want to make sure that the information we hold is accurate and up to date. You may ask us to remove or correct information you think is inaccurate. We will make all reasonable efforts to delete your information from our files if it is deemed appropriate.

9.3             You have the same rights to know what information is processed by any third party, or correct information held by them by contacting them directly. 

10        TELEPHONE CALLS

10.1           If you call us, or we call you, by telephone the call may be recorded for monitoring, training, quality and regulatory compliance purposes. Recordings will only be used under proper and careful supervision. 

11        CHANGES TO OUR FORM TERMS OF USE AND PRIVACY

11.1           We may change this Privacy Notice and Terms from time to time. This page will always show the current version but we will only use information in accordance with the version in use when the information was collected. 

11.2           If we wish to use information in a way that is different to that stated at the time we collected it, we will email you to inform you of how we intend to process your data and obtain consent, if necessary.

11.3           If we make any material changes in our privacy practices that do not affect personally identifiable information held by us we will post a notice on www.leadaffinity.com notifying users of the change. 

12        YOUR COMMENTS, CONCERNS AND COMPLAINTS

12.1           You can expect us to be prompt, efficient and friendly when dealing with you and we aim to deliver an excellent service. We hope that you do not have any issues but appreciate that sometimes things may go wrong. We welcome any feedback so please bring any concerns to our attention as soon as possible using the contact details provided below. We always endeavour to resolve any issues or complaints fairly. As an FCA regulated firm, we have a formal complaints procedure to ensure complaints are handled appropriately, a leaflet with further details is available on request.

12.2           If we cannot resolve a complaint to your satisfaction you can then escalate the matter to:

12.2.1       the ICO if the complaint relates to the way your personal information has been handled. See www.ico.org.uk; or

12.2.2       the Financial Ombudsman Service if the complaint relates to the financial services products and our credit brokerage service. See www.financial-ombudsman.org.uk.

12.3           Please note, if you have a complaint about an Affiliate website upon which the Form is hosted, an Affiliate's marketing, or the way you have been treated by a Lending Partner, please contact them directly. You should be able to find details of their complaints procedure on their website, but we would be happy to assist if you wish to contact us in the first instance and we will endeavour to put you in contact with the appropriate person where possible.

13        ACCESSING OUR FORM

13.1           The Services we provide are intended for those over 18 years of age only. If you are under the age of 18, you should not use this Form.

13.2           You are also responsible for ensuring that all persons who access our Form through your internet connection are aware of these terms of use and that they comply with them.

13.3           Access to the Form is permitted on a temporary basis, and we reserve the right to withdraw or amend the form or the Service we provide without notice. We will not be liable if for any reason the Form is unavailable at any time or for any period.

13.4           The Form is provided on an 'as is' basis. Lead Affinity does not guarantee that the Form or any content, document or feature of the Form will be error-free or uninterrupted, or that any defects will be corrected.

14        INTELLECTUAL PROPERTY

14.1           The Form, the content, any materials downloaded, and all intellectual property pertaining to or contained in the Form (including but not limited to copyrights, patents, database rights, graphics, designs, text, logos, trade dress, trademarks and service marks, the (Content) are owned by Lead Affinity and all rights, title and interest therein shall remain the property of Lead Affinity.

14.2           Any intellectual property belonging to Lead Affinity may not be copied, used, linked, disseminated, or otherwise used, without Lead Affinity's prior, express written approval.

14.3           You are authorised solely to view and use the Form for your own personal, non-commercial use.

14.4           You agree that you will not duplicate, publish, modify, create derivative works from, participate in the transfer of or post on the world wide web or, in any other way distribute or exploit the Form or, any portion of it for any public or commercial use without our express written consent.

14.5           You agree that you will not (i) remove or alter any author, trademark or other proprietary notice or legend displayed on the Form (or printed pages produced from the Form); and (ii) make any other modifications to any documents obtained from the Form other than in connection with completing information required to transact as a consumer applying for credit.

15        OUR LIABILITY

15.1           Lead Affinity shall not be liable to any person for any loss or damage, whether directly or indirectly sustained, arising from the use of any of the information or materials in connection with or related to your use of the Form. This does not affect our liability other liability which cannot be excluded or limited under applicable law or regulation, such as death or personal injury arising from our negligence.

15.2           The Form may be hosted, and will lead you to other websites which are not under the control of Lead Affinity. We accept no responsibility or liability for any of the information or materials contained in any website beyond the direct control of Lead Affinity.

16        LAW AND JURISDICTION

16.1           Your use of the Form is governed by the Laws of England and Wales whose courts have exclusive jurisdiction of any disputes that may arise under or in connection with this Privacy Statement and Terms.
